Third Generation11. William Jacob (Jake)3 Gross (John David2, David F.1) was born in Jackson County, AL 1863. William died bef. 1919 in Sevier County, AR. He married Martha Ann Hannah in AR, abt. 1890. Martha was born in AR September 10, 1872. Martha died November 22, 1945 in Sevier County, AR, at 73 years of age. The following was taken from notes by Stacie Davis: Mattie had a half sister named Alma Upchurch and a half brother named Alvy Upchurch (per Ray Davis). Mattie lived with Harve and kids for a while. They called her "Grandma Gold". She was 4'8" tall - very dainty. She wore a size 4 shoe. She was a good woman and a good cook. Ray remembered her making gingerbread for him. We think she may have been part Indian (either Caddo or Choctaw). Her death certificate states she had hypertensive heart disease. From Stacie Davis' notes: According to Raymond Davis, Jake and Mattie moved to Ben Lomond because Jake was sick and had to see the doctor every day (the doctor was at Ben Lomond). 12. Flora Ann3 Gross (John David2, David F.1) was born in Jackson County, AL April 19, 1865. Flora died July 7, 1936 in Haskell, Haskell County, TX, at 71 years of age. She married Luther Pressley Kennamer in Marshall County, AL, January 25, 1888. Luther was born in Kennamer Cove, Marshall County, AL August 11, 1864. Luther was the son of Levi Kennamer and Sarah Amanda Clack. Luther died March 19, 1909 in Haskell County, TX, at 44 years of age. Cora was born in St. Paul, Madison County, AR September 18, 1882. Cora was the daughter of John Preston Salyer and Rachel M. Estep. Cora died June 5, 1970 in Tucson, Pima County, AZ, at 87 years of age. Dated April 11, 1916 John Cordell Administrator. Thursday, November 8, 1923 DALLAS SOWELL LYNCHED BY MOB FRIDAY NIGHT Man Charged with Attack on Woman was Hung in Old Barn at Outskirts of City. Dallas Sowell, 18, accused attacker of a woman, was taken from the McIntosh county jail and lynched by a band of eleven masked men at 1:15 o'clock, Saturday morning. Taking advantage of the releasing of extra guards who had been on duty since Sowell's arrest, the band swooped down on the little jail and made away with the prisoner quickly and quietly. A posse headed by M. B. Moore, sheriff located the body of Sowell hangingto a beam in a barn in the northeast part of the town at 5 o'clock Appearing suddenly at the jail, the band overpowered Tom Ayers and Bill Carr, deputy sheriffs, who were sleeping at the jail, conversed with Sowell in low tones, and left, after locking the deputies in the jail and cutting the telephone wires. According to Carr, he was awakened about 1 o'clock by someone attempting to enter the office. Thinking it one of his deputies trying to get in, Carr unlocked the door. As he did so the door was thrown open and he was confronted by two men with pistols in their hands. he was startled and as he stepped back, he tripped over a board. before he could get up the men had him covered and he was ordered to keep his mouth shut. Ayers and a rancher, Bill Dice, who was also sleeping at the jail, aroused by the noise in the front office, came into the room. They were immediately covered by two masked men. Carr was ordered to produce the keys and when he made an evasive answer one of the raiders said he thought he could find them. It was some time before they finally located the keys under Carr's pillow. Several of the men then went to get Sowell, and after locking the deputies in the jail left in two automobiles. It was about half an hour later when the deputies succeeded in reaching a telephone to notify the sheriff. On Moore's arrival a posse was organized and the search for the prisoner was begun. It was 5 o'clock in the morning before they found the object of their quest. Sowell was alleged to have attacked Mrs. Bertie Montgomery wife of Jarbe Montgomery, at their home several miles from Eufaula on the morning of September f14. Montgomery was away from home, and his wife, who had spent the night with her parent, returned to her home and was seized by Sowell, who knocked her unconscious and is alleged to have attacked her. O. W. Beasley, a taxi driver, heard the woman's screams and ran to her assistance, but Sowell had escaped. He was caught by a posse later the same day and brought immediately to Muskogee, as three were threats of lynching and McIntosh officials were fearful if Sowell were lynched, it would mean martial law for the county. On September 26, while being taken back to Eufaula for preliminary hearing, Sowell escaped from Sheriff Moore. He was caught in the Texas Panhandle and returned to Eufaula for trial. Sowell was described variously as an Indian, a mexican, and a half-breed negro. After his return to jail it was decided to hold him in Eufaula for trial. There was a little talk of lynching at the time and extra precaution was taken by placing additional guards at the jail. The guards were released two days ago as it was not believed there would be any attempt to harm him. Eufaula is quiet today and with the exception of little groups of persons, there is no sign of anything out of the ordinary. Sheriff Moore and Ben D. Gross, prosecuting attorney are meeting this afternoon to discuss the procedure to be taken to learn the identity of the mom members. Carr said he was unable to recognize any members of the band as they all wore white masks, covering the whole face, with small holes cut for the eyes. Several of the men, for fear of identification turned their coats wrong side out. Okemah, Okla., Nov 7. -- Dallas Sowell, the man who was lynched at Eufaula last Saturday, was insane, in the belief of his mother and those who knew him about the Bigham neighborhood where he was reared. He was arrested here last February on a charge of stealing a watch and clock, but upon representation of his mother and County Attorney Tom Huser, was released. After about a month at home with his mother, he disappeared, later returning home with a pony fond to have been stolen near Sallisaw. He took the stolen pony and another and went to Okmulgee, where he was arrested and taken to Sallisaw. here he was adjudged insane, and was being taken to an asylum last summer when he escaped from officers. According to the mother the young man received a blow on the head when a small boy from which hen never recovered mentally. The body was brought to Okemah at the expense of McIntosh county and buried in Highland cemetery here. It has been definitely established here that Sowell was white and had neither negro or Indian blood as has been asserted by some. Thursday October 16, 1924 "BAD MAN" KILLED FEW HOURS AFTER WARDEN FREED HIM Joe Dick, with Four or Five Notches on His Gun, had Stepped from Prison at Noon Within eight hours after completing a sentence of ten years in the Oklahoma penitentiary at McAlester for the murder of Joe Francis, Joe Dick full blood Creek Indian of Eufaula was shot and instantly killed near here Saturday night by Roman Beaver, millionaire Creek Full blood. The killing occurred one mile west of Eufaula just a few yards east of Beaver's palatial home. Beaver and Dick met in the road and Dick started a quarrel with Beaver, according to the story told Mark Moore, sheriff of the county. After a few hot words had passed, Dick told Beaver "I am going to kill you because when I was in the penitentiary for killing Francis you with all your money, no send me nothing at all." Dick reached for a gun and was shot through the heart and upper lip by Beaver before Dick's gun was out of his pocket. Beaver loaded Dick into his car, drove to Eufaula and delivered the body to the undertaker. Then Beaver went to the county jail, where he surrendered to Sheriff Mark Moore with the words "I kill Joe Dick. Him bad Indian, say shoot me. I shoot 'em first." Beaver's attorneys immediately advised him not to make any further statement regarding the case. Joe Dick according to penitentiary authorities was discharged from the McAlester prison at noon Saturday, after serving ten-year murder sentence "the short way." With time off for good behavior in the prison, the full-blood Creek was given his liberty after serving five years and five days on the sentence imposed by the McIntosh county district court for the murder of Francis in 1918. Dick dropped off the Katy Flyer in Eufaula Saturday afternoon, bought a revolver, and started west from town, where he met Beaver. Beaver was driving his car, and had apparently just started to town. The shooting and Beaver's surrender all occurred with a short time after Dick left town. Sheriff Moore says that Dick was a "bad Indian". It is said that Dick has killed four or five other Creek fullbloods in the lst 20 years at Eufaula and in the neighborhood. Twice he has been given a short leave of absence from the penitentiary, and each time he got into trouble. Sheriff Moore having sent him back to McAlester each time. Beaver owns several hundred acres of land in the Bristow oil fields and is exceedingly wealthy. He bears the reputation of being a good citizen. His defense to the killing, when his preliminary came up before Justice of the Peace Chapman here Tuesday afternoon, was self-defense. Justice Chapman held the prisoner for first-degree manslaughter and set his bond at $5,000.00 which Beaver immediately made. His case will probably come up for hearing at the next regular term of district court. Green & /green represented the defendant at the preliminary hearing, while the state was represented by County Attorney Ben D. Gross and special counsel Jack G. Harrley of the law firm of Turner, Turner, Harley & Parris. Thursday July 31, 1930 JUDGE BEN D. GROSS DIED HERE MONDAY Answering the final summons to the Great Bar, Judge Ben D. Gross passed away at his home, Monday July 28, at 1:30 p. m., after a long and lingering illness. He was born in Scottboro, Alabama, March 4, 1872 and in that place he received his high school and collegiate education, after which he attended law school at Lebanon, Tennessee, where he was admitted to the bar. In 1900 he came to Oklahoma to practice law at Muskogee and two years after he moved to Checotah. He married Miss Cora Elizaabeth Salyer of Hindsville, Arkansas in 1904 and when elected judge of McIntosh county he moved to Eufaula with his family. He has been prominently connected with civic and religious organizations affiliating always with those movement for the advancement of his town. Besides serving as County Judge he was also county attorney for a term of years and city attorney for two terms, filling acceptably each position which he held. He was known in the community as a man of high principles whose honesty and integrity were unquestionable. He was out spoken in his defense of right doing and his legal ability was recognized by his friends and colleagues. Early in life he united with the Methodist church and at the time of his death he was one of the member of the Board of Stewards. He is survived by his widow and two children, Ben D. Jr., and Rachel Eugenia who was married in 1926 to Mr. C. M. Nye of Okemah. To these, the sympathy of the entire community is extended in their hour of bereavement. The beloved daughter, Eugenia was prevented by illness from being present, but in a special delivery letter she made the request that at the funeral services the song, "Beautiful Island of Somewhere," be sung by a quartette in her memory. Her wish was carried out very beautifully when the services were conducted by the Rev. W. W. McConnell at the Methodist church Wednesday at 4 p. m. Many floral tributes manifested the esteem in which Judge Gross was held. Business was suspended that his associates might pay their last respects to their departed friend, who was laid to rest in the cemetery at Eufaula. He was the son of Zacheus Kennamer and Rachel Ann Morgan Gross. He attended the public schools of Jackson County and Massey Business College in Montgomery, Ala. In September 1908 he entered Southern University, Greensboro, Ala., from which he received the A. B. degree in June 1912. Gross joined the New Hope Methodist Church on the Columbus City Circuit, in the Huntsville District. Shortly after entering Southern University, he was licensed to preach by the Greensboro Quarterly Conference, October 1908. After graduating in 1908, he served as a Supply, at Morris, Oklahoma in the East Oklahoma Conference, which received him on trial in November of that year. He returned to Alabama at the end of that Conference year. He was transferred to the North Alabama Conference, and appointed as Junior Preacher at Scottsboro and a short time later to Paint Rock Circuit. After one year he transferred back to Oklahoma where he served until the fall of 1920 when he was transferred to the Alabama Conference. He was ordained deacon and admitted into full connection in November 1915, and ordained Elder by Bishop E. D. Mouzon in 1917. While he was attending school in Greensboro, he met Flossie Ellis Grote and they were married June 28, 1916. They had four children: Theresa Grote, Elizabeth Greenwood, Thomas Jefferson, Jr., and Dr, Charles Morgan Gross. She and her infant daughter both died the day after giving birth. Her headstone at Ben Lomond Cemetery is tall and is engraved with "In everlasting memory of Myrtle Davis and infant baby - wife and daughter of C.H. Davis". Grandma Gold (Myrtle's mother) told Ray that Myrtle's husband, Henry, used to come visit her for years even after Myrtle died. Zella died July 7, 1931 in White Cliffs, Little River County, AR, at 33 years of age. Her body was interred in Brownstown Cemetery, Sevier County, AR. She married Harve Burt Davis in Little River County, AR, September 6, 1913. Harve was born in Fomby, AR March 21, 1889. Harve was the son of John D. Davis and Martha Ann (Mattie) Catching. Harve died May 5, 1948 in Little River County, AR, at 59 years of age. His body was interred in Brownstown Cemetery, Sevier County, AR. The following was taken from notes by Stacie Davis: Harve was 3 when his father, John, died. He took care of his brother John's kids, Buddy and Lillie, before he married Zella. John had asked Harve to take care of them. He and his wife both died of swamp fever or typhoid. The kids called Harve "Poppa". He was known as having a temper, and was said to have beaten one of his brothers off of a horse one time during an argument. However, he was always giving food to those who needed it in the White Cliffs area. Helen said she thought half of the people down there would have starved to death if not for Harve. The family lived in White Cliffs, in the Little River bottoms. Harve did some farming, but mostly log hauling and raised hogs. He was the last man in that part of the country to use oxen to farm. He was also a barber and played the fiddle. They had running water in the 1920s - 30s. They used a Dynamo pump to pump water from the river up to the house. Also had an artesian well on their property. Ray said there was an old shipwreck where a ship of settlers sank in the Little River down from their old homeplace - south of the old piers. Account of Harve B. Davis' death as told by his son, Ray Davis January 29, 1998: "Poppa's horse and dogs came back without him. The saddle was pulled back on the horse. The horse's mouth was all torn up from the bridle. It took them 5 days to find him. They called out the National Guard to help find him, but they couldn't track him because it rained so hard the night he went missing. About 100 people stretched out and walked hand to hand from east to west, and north to south. Buster Bailey, Eula's husband found him about 2 miles from their homeplace in the Little River Bottoms. He hadn't been dead long when they found him. Helen said when she viewed his body that he had been torn up pretty badly from being trampled by his horse. His hand had been cut open - probably from trying to hang on to the rope. They think his foot was caught in the stirrup and the horse dragged him round and round (the ground was torn up in a circle where they found him). It had rained really heavy. Helen said his knees were muddy like he had gotten to his knees. Harve had pulled himself up and was laying against a log. They took an axe and carved Harve's name in the holly tree where they found him." Harve's death certificate states he had a "heart attack followed by falling from his horse, being drug by same and exposure." The following was taken from notes by Stacie Davis: Harve and Zella's daughter that died in 1923 was Greta's twin. Greta was born premature and since there were no incubators back then, they put her in a wood cookstove to keep her warm. Harve called Zella "Bill". Zella and her sister, Myrtle, used to fight like boys all of the time, and Grandma Gold told them if they kept it up she was going to give them boy names. So Zella's name was "Bill" and Myrtle's was "Tom". Ray was 2 years old when Zella died. Her death certificate states she died of pulmonary tuberculosis following influenza 16 months previous (date of onset Feb. 1930). Helen said after Ray was born, she got sick and just never got any better. She said Harve stood by Zella's bedside with tears streaming down his face and watched her die a very peaceful death. Harve never remarried. Zella Mattie Gross and Harve Burt Davis had the following children:
