Thomas M. Boggess was a Private in Arnold's Company of Ala. Mounted Volunteers. "Alabama Soldiers in Creek Wars" 1838, 8 Feb. P.H. Bell, Gov. of Texas, granted to Thomas M. Boggess assignee of Henry M. clements, 1280 acres situated in Fayette Co., Tx. on waters of Rabbs Creek about 12 miles NW from La Grange - by virtue of Bounty Warrant #2314 issued by Barnard E. Bee, Secretary of War. Transferred to sd Boggess 6 July 1838. Done at city of Houston 23 Oct 1850 by P.H. Bell, Governor. Fayette Co., Tx. Deed Bk. G: 563 1838, 23 Feb. William and Susanah Burney sold 320 acres to Benjamin Briggs Goodrich (May 1838) and Goodrich transferred rights, title, etc for $640 to Thomas M. Boggess. Montgomery Co., Tx. Deed Bk. Deed Bk. B: 282 1838, 6 July. Thomas M. Boggus was granted a Class 2 Certificate for 640 acres in Fayette Co., Tx. (Class 2 Certificates were given to settlers arriving in Texas after 2 Mar 1836 but before 1 Oct 1837. Amounts were 1280 acres for heads of families and 640 acres to single men 17 years of age before 1 Oct 1837. Thomas was bound for $2,000 on condition title would be given as soon as obtained from the Government to make or cause to be made unto sd Hudson, a good and valid warentee title deed. SW of La Grange, containing 1 League & 1 Labor surveyed by Thomas Green surveyor of Fayette Co. for the vendor by virtue of headright certificate of Geo. Massangill #383 by board of Land Commissioners of Co. of Shelby 31 Mar 1838 to Wm. Daniels as assignee of sd Massangill which sd certificate was assigned and transferred by sd Daniels to this vendor 3 Apr 1838). Agreed by vendor & purchasers the League & Labor shall be divided into equal parts by line running N & S and purchasers shall have liberty of choosing which half they will take. Boggess, dec'd., filed petition to authorize him to sell head right certificate #245 of 640 acres granted to him as Adm. of sd est. on 20 Feb 1850. On 1st June 1850, after advertising for 20 days according to law, Chandler sold sd land to N.W. Faison as highest bidder - $38.50. (Faison then sold his right to the certificate to A. L. Vail for $50 and Vail then sold ti for $55 to Harold Chrisman.) Williamson Co., Tx. Deed Bk. 17: 488 1850, 2 July. F.M. Chandler, Adm. of estate of Thomas M. Boggess, dec'd., of Fayette Co., petitioned court for an order to sell @/3 of 2 towns lots in town of Washington, Washington Co. (Lots 11 and 12 in Block 18). After advertising according to law, sold to highest bidder, N.W. Faison for $12. Washington Co., Tx. Deed Bk. I-J: 340 1850. Frederick Chandler, Adm. of estate of Thomas M. Boggess, dec'd., filed petition in Fayette Co. to sell 320 acres belonging to sd est. of sd Boggess situated in Fayette Co. The court authorized Chandler to sell sd land, whereas sd Chandler did on the 1st Tues. on Nov., after having advertised sd land at 3 public places according to law, 1 of which was posted up on the court house door in town of La Grange. Second Generation4. Timothy M.2 Boggess (Samuel?1) (#1689) was born in TN 1807. Timothy died 1840 in AL, at 33 years of age. He married Pheriba Starnes in Marshall County, AL, 1830. (Pheriba Starnes is #1690.) Pheriba was born in Warren County, TN December 24, 1811. Pheriba was the daughter of John H. Starnes Jr. and (Unknown) (Unknown). Pheriba died November 20, 1902 in Marshall County, AL, at 90 years of age. The following was taken from "Starnes of the South" by Jessie Ruth Russell, page 328: "The only records found of Timothy M. Boggess is a deed dated 3 Aug. 1835 made by him and Phriba in Jackson County, and some store accounts dated 1835 and earlier. He died young, it appears, in the Hebron vicinity, leaving two young sons. They lived at Claysville but later moved to New Hope and were living at the old William Lewis place when she died. She lived out her life with her son, Thomas. She was a member of Henryville Methodist Episcopal Church South. From its list of "departed members" her approximate death date was obtained: Nov. 1902. She is listed with her two sons in the 1860 Census Marshall Co., Ala. Claysville Precinct, p. 33. In the 1870 Census Marshall County, Alabama T7, R4, Woodall, she was living with her son Thomas at New Hope... Her name is spelled "Phriba" on her death certificate. Her birthplace, however, was incorrectly reported as Alabama by her grandson who was a doctor, J. W. Boggess of Bridgeport, Ala. Her husband's name was given as Timothy W. Boggess, born in Tenn." Boggess, and Polly Boggess reside beyond the limits of the state, Timothy Boggess resides in St. Francis Co. Ark. and Polly Boggess in the State of Texas. Peter Kilfoyln Register and master of said court. Substance of bill; Commisssioners Court Roads and Revenue for Marshall Co. obtained license to keep a public ferry across Tennessee River. That one John S. Boggess and Richard S. Randles had prior to that time kept a public ferry. That John S. Census [P120B]: Feraby Boggess 59 years old living with son Thomas 35 and his wife Sealy 33. 1880 Marshall Co., Ala. Census [P157-185]: Pheriba Boggas 67 years old living with son Thomas J. and family. 1885, 29 Jan. Pheriba Boggus sold 40 acres to William Lewis for $500 in Twsp. 7, Range 4 East. Marshall Co., Ala. Deed Bk. O: 200 1900 Madison Co., Ala. Census: Pheuba Boggus 88 years old, living with son Thomas J. and Cela. Timothy M. Boggess and Pheriba Starnes had the following children:
Wade H. Boggus and Dorcus C. McCord were issued a marriage license on November 20, 1860 by J. H. Norwood JP and were married on November 27, 1860 in Jackson County, AL by Henry E. Poarch MG. (Source: Marriage Records Jackson County, AL 1857-1869, page 82 -- LDS Film# 1028279) (Darcus C. McCord is #1866.) In the 1860 Jackson County, AL Census [P619], there is a Darcus McCord age 25 School Teacher living in the household of Mark and Rebecca Kelly. Wade was a Pvt./2nd Lt. in Co. E of Hale's 31st Alabama / 49th Alabama during the Civil War. His brother Thomas served with him.
5. James2 Boggus (Samuel?1 Boggess) (#2040) was born in TN about 1807. James died February 1863 in Marshall County, AL, at 55 years of age. He married Nancy (Unknown). (Nancy (Unknown) is #2041.) Nancy was born in GA about 1810. Nancy died about 1868. Prior to 1830 and had land north of the Tennessee Rr. He was 1 of the 1st commissioners. "History Co., Ala." (Marshall Co. was not formed until 1836 from Blount, Jackson, and Cherokee Cession land). 1830 Jackson Co., Ala. Census: James Boggess with 1 male and 1 female under 5, 1 male 10-15, 3 males 20-30, 2 females 20-30. 1830, Oct. James Boggess was granted 83.50 acres. 1832, Apr. James Boggess was granted 165 acres. 1833, 13 Nov. James Boggess bought from John Martin and wife Clarinda of Madison Co., Ala., land in Jackson Co. (E half of NE quarter of Sec. 24, Twsp. 7, R 3E) for $125. Marshall Co., Ala. Deed Bk. A: 10 1836, 9 Apr. James and Nancy Boggess of Marshall Co., sold land to Robt. Chandler of $500, bieng the same land he bought form John Martin in 1833. Sale was acknowledge by James and Nancy in Claysville, Marshall Co. at which time Nancy relinquished her right of dower. Purvin 18 (day laborer). 1866, 26 Mar. Bill of Complaint - Nancy Boggus vs. Patrick Henry. This case states: That prior to Mar 1833 Nancy and James Boggus intermarried, and lived together as husband and wife until his death in Feb. 183. 18 Mar 1833 James aliened and conveyed 165+ acres (described as NE quarter of Sect. 13, Twsp. 7, R 3E) to John Johnson in trust to secure payment of a debt due and owing from James to Samuel and Hugh Henry. Hugh Henry obtained possession of sd land and since that time to Patrick Henry. Nancy claimed she never relinguished or surrendered her right of dower in sd land. It appears that Nancy died before the suit was settled because a letter of Administration was issued on her estate on 21 Sep 1868 as part of the court records. Marshall Co., Ala. (Harrison?)2 Boggess (Samuel?1) (#1966) was born in TN about 1808. Henry died about 1860 in Anderson, Grimes Co., Tx. He married twice. He married Harriet C. Goddard in Knox County, TN, April 29, 1833. (Harriet C. Goddard is #1971.) Harriet was born in Knox County, TN November 22, 1817. Harriet was the daughter of William Goddard and Jane Campbell. Harriet died Mary 3, 1851 in Anderson, Grimes County, TX, at 33 years of age. He married Mary R. Pratt in Grimes County, TX, December 10, 1852. (Mary R. Pratt is #1977.) Henry W. (Harrison?) James 12, and Charles A. 9, are living with bro. John A. Henry H. Boggess came to Grimes Co. early 1840's from Mississippi. He had a grocery store on the Courthouse Square approximately where the Courthouse Annex now stands. He was Justice of the Peace for several terms and Anderson's 2nd Postmaster. "History of Grimes Co., Tx." Henry Boggess was a devout Methodist who was noted for his honesty and fair dealing. W.P. Zuper says of him, "He made a good living but not a fortune. He was respected by all who knew him. He served several terms as Justice of the Peace. Though never wealthy, he died with a good conscinece which is far better than all earthly wealth." "Saga of Anderson" Mrs. Harriet C. Boggess, consort of H.H. Boggess, Esq., and d/o Jane and William Goddard died in Anderson, Grimes Co., Tx. 3 May 1851. She was born in Knox Co., Ten.; married H.H. Boggess in 1833 Knox Co., Ten.; moved to Benton Co., Ark, then to Tx. in 1840. 4 children have died before her, leaving 4 sons and a bereaved husband. Abstracts from Wesleyan Banner. Harriet C. Goddard (22 Nov 1817 - 3 May 1851), d/o William and Jane (Campbell) Goddard, was born in Knox Co., Ten.; died in Grimes Co., Tx. She married 29 Apr 1833, Henry H. Boggess. They removed to Benton Co., Ala., and from there in 1840, to Grimes Co., Tx. Harriet became a member of the Methodist church in 1849. Four of their children died before her death. Her husband and 4 sons who survived her were living at Anderson, Tx. in 1851. "The East Ten. JOHN WILSON BOGGESS SR. was the first of four generations of medical doctors to practice in the Guntersville/Scottsboro vicinity. He was a resident of Columbus City, practicing his profession until 1898, then moved to Dry Cove near Woodville and practiced there until near the time of his death. Both he and Margaret are buried in the Union Cemetery at Woodville. According to The Guntersville Democrate, Dr. John W. died suddenly at his home at Woodville on Mon. night Dec. 2, 1940 about ten o'clock of heart failure. His funeral was held at Woodville Methodist Church and burial in Union Cemetery. He was survived by his widow, two daus., Mrs. L. M. Murphee of West Blocton, Ala. and Mrs. C. T. Boggess, Claude French Saunders and Will Taylor, all bachelors, traveled from Alabama to Oklahoma together in the late 1890s. Lycourgus Gross of Beaver County, OK purchased 160 acres of land in Section 5 of T1N-R22E on February 10, 1910. The following was written by LaVona (Gross) Harris -- Lycourgus' daughter: "Lycourgus Vernon (Curg) Gross came from Scottsboro, Alabama, to El Reno, Oklahoma where he was employed by the telephone company. From there he came to Beaver County in 1903, and filed four miles south and one mile west of the town of Balko. In 1906 he was married to Minnie May Gregory of Elk City. The Gregorys had moved to Oklahoma from Missouri. Following their marriage, the young couple came to Beaver County to make their home on their claim. The trip to their new home was made by covered wagon. The main highlight of the trip being the fording of the Canadian River. There was a wagon trail across the river, but in places just off the trail there was quicksand. When the river was up at a ??, the trail was very hard to follow. This was the condition of the river when Curg and Minnie started across. About half-way across they passed a wagon that had gone down in the quicksand. Only the tongue of the wagon was sticking up out of the water. The family had been rescued, but the unfortunate party had had to cut the horses loose form the wagon, and all their belongings had gone down. A very frightened young couple, with a prayer in their hearts, made their way on across the river. When they got to their new home, which had been fully described by the young husband, dirt floor and all, Minnie could not believe her eyes! The twelve foot by fourteen foot dugout looked much smaller than her mind had pictured it. She knew they could never get all their belongings inside, but of course they managed. Their life was filled with early day joys and hardships, but in a little while homesickness overcame the young bride. The dugout had one window and by climbing upon a chair she could look out across the lonely prairie. Minnie said she spent quite a bit of time at that window crying, wishing she could see her folks. There was no question as to whether or not she could go see them. The mode of travel was too slow, and there were no funds for trips. As time passed a family was started, friendships developed, and church and other community activities filled their time. Neighbors were very dear. Each helped the other in times of need. Trails across the prairie between homesites were made by visiting neighbors. Taffy pullings were pleasant memories to many. Work on the farm began very early in the morning, in order that all chores would be finished and field work could start as soon as it was light enough to see. They worked as long as they could see in the evening. Curg and Minnie had nine children, eight daughters and one son. Their second daughter, Tessa passed away at the age of two. The other children are these: Dolleta, Davis, Perryton, Texas; Valena Maxwell; Zella Lile; LaVona Harris, Balko, OK; Lorena Johnson, Perryton, Texas; Opal Gray, Borger, Texas; Leroy Gross, Amarillo, TX; and Irene Anderson, Lomita, California. Things went fairly well for the family, and a frame house had replaced the dugout. Then the depression and the dust storms came. The family moved from the homestead in 1936. Elsie died April 29, 1963 in Chickasha, OK, at 78 years of age. Her body was interred in Fairlawn Cemetery, Chickasha, OK. Conflicting evidence states that Samuel was born in AL, 1873. Samuel along with Lycourgus Gross (brother), Hurt Winston, French Saunders and Will Taylor (soon to be brother-in-law), all bachelors, traveled from Alabama to Oklahoma together in the late 1890s. Sam Gross of Texas County, OK purchased 80 acres of land in Section 29 of T1N-R14E on November 9, 1908. (*Note from SB -- I've been told that this was probably written by Neva Gross Bolton): "Papa (SAMUEL GROSS) was born and spent the first 21 yrs of his life on the home place of ISAAC GILMORE GROSS and CAROLINE BOGGESS GROSS. She had been married to UNKNOWN (ISAAC) BENSON. He was injured in a accident, his leg was crushed between two logs. Blood poisoning set in, took his life. Steam boats traveled the Tenn River to haul freights on barrages, up and down the river. The train tracks came to the river and the barrages hauled them to Decatur Alabama and unloaded them. Grandma and Grandpa VINEYARD lived in Alabama too, not far from Botgringham and across the mountain from where papa's family lived. They moved to Oklahoma about the same time in 1900. B. Gross and wife at the funeral they both look good for their ages. Hurt called me from Lone wold, and told me Jim had passed away. i had just got a card from Tishie at noon telling me jim was very sicj he had passed away about the time i taken the card out of my mail box Jim died about 11:45 a.m. march 6, i drove down on sunday march 7, to hurts and on monday march 8, we drove over to Granite and loaded Jim Lanier in to the car and drove up to carter, they held the funeral at 2:30 march 8, they were a very large crowed will i have one thing to rember Jim was a good boy all his growning up and lived it all his 79 years six months and 2 days.
