Aug. 3, 1999

Contacted Richard Szarek from Region of Durham's Planning Office. He informed me a letter was being prepared for Peter Prust at Bloom Maker Soils Inc., new owners of Pefferlaw Peat Products. Letter is to be forward to the Task Force. Please see letter for details listed August 9,1999

Aug. 4, 1999

Talked with Debbie Bath (Ward 4 councilor) on the issue. She is awaiting the letter.

A hand delivered copy of the letter was taken to the Township of Brock Municipal Offices and given to the receptionist.

Aug. 5, 1999

Ian Buchanun from the OMNR called to inform us he would visit the site today.

Continued damage being inflicted on the bog. More grading today.

Aug. 6, 1999

Talked with Ian Buchanun and he informed us that he doubted whether the OMNR would be able to do anything about the access. Although there was year round water here, it was considered a ditch and not a natural waterway. He did confirm that there were fish within the water and it might be considered a new fish habitat area. We will be contacting the local conservation authority about this. Ian Buchanun will be taking up other issues relevant with his supervisors.

Aug. 7, 1999

Continued work on the Web-site

Contacted the Lake Simcoe Region Conservation Authority and discussed the problems to find out what they could do to help protect what on paper, is already protected. They requested a letter. When mentioning the fish being present at the bog, they took note but suggested I further investigate this through the Federal Department of Oceans and Fisheries.

Drove by the bog today to access the damage. The section that was damaged in 1981 and halted by the OMB ruling has been almost completely leveled and is ready for peat extraction.

Received copy of letter from the Region. It is in great support for our cause. Copy of Letter

Aug. 10, 1999

Bog continues to be damaged with more activity today. We question whether or not Pefferlaw Peat Products has received the letter as yet.

Aug. 12, 1999

Web-site was preliminarily published today. Select persons contacted to review it.

Aug. 13, 1999

Mary Green was contacted and a meeting of The Task Force For The Preservation Of The Wilfrid Bog is being called. Details to follow. Mary is the chairperson for the task force and has just returned from 2 weeks of holidays. She was shocked at the site of the bog and the damage incurred.

All was quiet at the bog today. No further damage.

Quiet again today at the bog. No further damage.

Aug. 17, 1999

The Task Force acquired a letter today in response to a third party individual who had made an application to Durham Region regarding tree cutting on the EP portion of the Wilfrid Bog. The application was turned down. Copy of Letter

Quiet again today at the bog. No further damage. This is encouraging.

Aug. 19, 1999

Prepared and mailed a letter to the Lake Simcoe Region Conservation Authority. Copy of Letter. Also faxed a copy to the head office of the LSRCA.

Aug. 23, 1999

Quiet again with no further disturbance within the bog's EP section.

Aug. 24, 1999

Pefferlaw Peat Products was on the protected side today. Surface was graded even, leveling areas which had begun to pile. Members of the task force were contacted and follow-ups to letters and phone calls will be made.

Aug. 26, 1999

Received a phone call from Debbie Bath (local ward 4 councillor). She is reviewing the history of the case and will be bringing it to council shortly. We have made her aware of the Web-site.

Aug. 27, 1999

Received a phone call from James Watt of the LSRCA. He will be sending a letter to Pefferlaw Peat Products in regards to the complaints.

Pefferlaw Peat Products entered the bog at late day and removed several loads of peat from the area of concern. Photographs were taken by two parties. Durham Region's Richard Szarek will be contacted on Monday.

Aug. 28, 1999

Pefferlaw Peat Products brought in another bulldozer and began destroying more sections, including some fairly substantial regenerated areas. There was extensive damage done and it becomes clear that if enforcement of one or more of the laws and/or policies applying to this property are not implemented immediately, this bog may be leveled. We believe that it is not without plan that this major hostility has started on the eve of the weekend.

Telephone calls were made today to:

Durham Region Planning, Mr. Richard Szarek:

Informed Richard of the new damage and the matter of peat removal. He informed me that peat extraction was definitely in contravene of the zoning bylaw so he made it clear that the municipality of Brock is responsible to send their bylaw officer to the property and put a stop work order on the site. After this first step Durham Region would follow suit by enforcing the Durham Region Conservation Bylaw.

Regional Councillor, Mr. Larry O'Connor:

Informed our Regional Councillor of the situation and the potential procrastination of our town councillors. He promised to get in touch with Brock Planning and Durham Planning and to become involved with our issue.

Lake Simcoe Region Conservation Authority, Mr. James Watt:

Talked with James Watt and conveyed the urgency of the situation with the new damage being inflicted. He expressed to me that he would expedite the matter and have a letter prepared shortly on the issue, to be presented to Pefferlaw Peat Products.

Ontario Ministry Of Natural Resources, Mr. Ian Buchanun:

A message was left and we are awaiting a return call.

Municipality of Brock Planning, Mr. Tom Getginby:

Tom informed us that the bylaw officer would not be permitted to act on this matter until the council resumes on September 20, 1999 (the council recessed for holidays on July 28, 1999 and resumes in September). We informed him that our Bylaw Officer has been well trained on her duties and that a council meeting should not be necessary to decide whether or not, or how to go about, enforcing an obvious infraction of the municipalities bylaws. He responded by analogy, telling us that if we were talking of an unimportant matter such as an old unused car sitting next to someone's manicured lot, there would be no trouble for the Bylaw Officer to act on policies without the councils consent. If however an important issue arises, the council would need to be called in order for the Bylaw Officer to act on the policies. This appears ludicrous as all infringements could be executed and evidence removed before any action may be taken on many important matters. With the Wilfrid Bog, this could mean the demise of the property before any steps may be taken to prevent what obviously will be further future damage. We will be asking the Bylaw Officer, Jan Holder, if she has been directed in general or on this matter only. Tom also suggested that we place the injunction on the property at our own expense. I informed him that it was the towns responsibility to pay the legal costs and that monetary matters cannot dictate which laws will and which laws will not be applied. By our constitutional right, the town was responsible to us to uphold these important bylaws and if not, we will go higher to someone who will.

Durham Region Planning, Mr. Richard Szarek:

Talked to Richard about the conversation with Tom at Brock Planning. He was already aware of the developing situation and is investigating the matter further. He will be meeting with his colleagues along with Durham Regions solicitors tomorrow on the matter.

The Brock Citizen (local newspaper), Mr. Jeff Bower:

We contacted the local paper to inform them of the trouble at Wilfrid Bog. The editor was unaware of the matter and we will be meeting with him this week to go over the situation so as events can be brought to the attention of the community.

Pefferlaw Peat Products entered the protected side and pushed peat into a ridge at the centre of the disturbed area.

Aug. 31, 1999

Telephoned Jan Holder (bylaw officer), Chris Hodgson (M.P.P.) and Debbie Bath (Ward 4 Councillor).

Jan Holder:

Confirmed the policy of our local council that all matters other than smaller infringements must be approved by the local council before the bylaw officer can apply any charges. On the topic of the Wilfrid Bog, she was concerned the tax payers of Brock would be saddled with major legal costs to pursue this matter. This, of course, is immaterial to the fact that constitutionally as our elected council, the bylaws must be applied. Our opinion is it should be dealt with much sooner than September 20, 1999 and therefore a special council meeting should be called to resolve the matter.

Chris Hodgson:

Was unable to talk to Chris but he will be calling us on the matter, according to his receptionist. Discussed briefly the issue with the receptionist and made her aware of the Web-site so as Mr. Hodgson could become updated on the situation.
