Me fine. I had a pep rally today. It was fun, but it was also boring... nothing to do except shout and stand up.

I'm thinking of getting a domain again. I'm ready to actually go and ASK for help from my dad to do it. Wish me luck...

Me HappyA lot of cool stuff happened to me today. Well, most of it, anyway...

  1. It's my sister's birthday.
  2. We got to see our school's orchestra and two bands perform today for the first half of the morning.
  3. I went up to visit my sister in the northeast part of the state. 
  4. We went to a japanese restaurant, which is known for giving an extravagant show with the meal.
  5. We went back to my sister's apartment to eat ckae and have her open gifts.
  6. We had a damn good time.

Me SadAGH! I spent the whole day doing homework, working on new MesageBoards (Inside The Web is closing, you see, so the boards go with them), and talking with my friends, and I've ignored my journal! My cramps are pretty much gone, but now I have a cold... *sniffle*

Ah, well. I have just one question for you guys to answer on the messageboard before it closes; would you do another guy's homework essay for $20?

Period- Day 2Spent the day playing Threads of Fate, messing around on the web, and exercising while dealing with cramps.

In other news, I wrote a letter to someone who was obviously mistaken about Warner Bros. and their domain dispute. The following below is the letter I sent him.


Unfortunately, sir, you do not realize what you are up against. Allow me to introduce myself first— My name is Jekkal, and I run a column called Corporate Bandwagon at fanfiction.net (just go there, and look to the right; you should be able to find it). My column deals with copyright issues for all fandoms, and not just Harry Potter. Speaking, however, as a columnist who has follwed the Harry Potter Domain Problem from step one, I can say with very little chance of rebuttal that I know more of the story than you do.

If you had actually read the 'PotterWar' website as well as the dissection of Claire Field's letter sent by Theodore Goddard (WB's lawyers), You would have noticed that nowhere in the ORIGINAL letter did they ever state that they wanted clarification of the intent of the website. Furthermore, they wanted it turned over to their possession within fourteen to twenty-eight days of the letter being sent. This letter has been dissected by normal people and by lawyers which have roused to PotterWar's support, free of charge.

In response to your demand of proof that Warner Bros. is in a lawsuit, I can think of one off the top fo my head; Claire Field and her parents are currently preparing to go toe-to-toe against Warner Bros. in court. At least one well-known domain has been shut down because of this, and many other less-known domains have probably fallen to the ax as well.

The 'legal obligation' to keep an eye on their trademark is not an excuse to go after fan sites. After all, fan sites are considered 'fair use' of the trademark, and no more a copyright infringement (nor much different) than a newspaper review. Many companies have opted to just let fans do as they may, and even a few encourage there to be fan sites abound. However, Warner Brothers has chosen the third road.

I do believe that your registration of a .org and a disclaimer are not sufficient to keep you safe. Warner Brothers has been mostly going over co.uk addresses, where press coverage is low and Harry Potter is rife. I can't BELIEVE this guy doesn't get it! If your site has been ignored, it is only by the good grace that your site is undoubtedly American, which is a group that Warner Bros. knows will make more noise than your average Brit—not to mention more press coverage. Believe me, we are all in the same boat, and you will be no safer than the next .com if Warner Bros. sets a new standard in copyright protection.

Warner Bros. has been working to cover its tail very efficently by very small (not public) aplogies to those who got the word out, and also by boasting very loudly (publicly) about the 107 Harry Potter domains which they recovered from a true cybersquatter, using that example as the reason they have been attacking fans. There is no doubt that Warner Bros. is exercising its powerful financial force, including the new muscle they gained from the AOL Time Warner merge, to silence as much of the web as possible.

I encourage you to, if nothing else, go see my column at www.fanfiction.net and read what coverage I have given this Harry Potter case in issues Three and Four. I must encourage that you understand the reality of what PotterWar and DADA are fighting for. I would not be against Warner Bros. myself, if I actually believed they were acting in the best of faith. However, they are not, so I am not.

1:53 PM - I don't like Sundays. Sundays are when I have to take everything of last week off of the index page, and make a new archive page for it.  I also try to write a long enough entry in my journal to match the length of the sidebar... I guess it comes with the territory. *shrugs*

A visual representationEh. That's not the reason I hate today.The real reason is PMS... started my period today. Now, for those of you who have schools that teach crappy sex ed (such as mine) a period is when blood flows out of a female's vagina for 4-7 days. The female is often crampy and irritable during this time, SO MAKE SURE SHE FEELS GOOD!

Me fine10:59 PM - Okay... a quick run-down for everyone who gives a hell:

  1. Everything about AOL sucks, except for Instant Messenger.
  2. I finally figured out how to use the 'difficulty' command in SHEEP to make it easy.
  3. In said game, my progress is at Jurassic PlayGround at medium Difficulty, using Shep.
  4. Spyro Prime Part 5 - Fight, Fight, Fight! - at If I worked for Insomniac (see link on sidebar) is now fit for public viewing.
  5. So is Corporate Bandwagon, my column at fanfiction.net
  6. I found a great website called Snopes that specializes in urban legends.
  7. I started working on a Puzz-3d that I bought for $5.00 (on major discount), and I got the main body of the puzzle done already.

Feeling better than I was this morning, but still crampy. Ah well.
